Understand Your Rights in Rockford Easement Disputes

Easement disputes can determine whether an owner may cross, improve, restrict, or continue using part of a property. We help residential and commercial property owners understand access rights, deed restrictions, subdivision covenants, and other land-use issues connected to real estate transactions in Rockford, Illinois, and throughout Northern Illinois.

At DeRango & Cain, LLC, we analyze property surveys, review historical records, coordinate with title companies, and represent clients in negotiations or formal proceedings. Attorney Elizabeth M. Types of Easements Recognized Under Illinois Law

An easement is a legal right to use land owned by someone else for a defined purpose. The controlling rights often depend on how the easement arose, the language of any recorded document, and the parties’ historical use of the property.

Common easement issues in Illinois involve:

  • Written easements: A written grant may establish a right of way or another defined use. An interest extending beyond one year generally must be written and signed.
  • Implied easements: An easement may be implied when a common owner divides land and the prior use of one parcel for the benefit of another supports continued access or use.
  • Ways of necessity: A way of necessity may arise when an owner conveys a parcel with no outlet to a highway except across land retained by the grantor.
  • Prescriptive easements: Illinois generally requires 20 years of use that’s adverse, uninterrupted, exclusive, continuous, and made under a claim of right.

A prescriptive easement is based on long-standing use rather than an express written grant. Whether the required elements are present depends on evidence showing how the land was used, whether the owner permitted that use, and whether an interruption occurred during the 20-year period.

Easement Disputes in Rockford

A disagreement may begin when an owner blocks a driveway, expands the use of a shared access route, challenges a boundary, or claims that an old easement is no longer valid. Post-purchase disputes can also arise when a deed, title record, or property survey reveals a restriction that wasn’t understood during the transaction.

The document creating the easement usually provides the starting point for evaluating its location, purpose, permitted users, and scope. Surveys, historical property records, photographs, maintenance history, and physical evidence of prior use can clarify the parties’ positions.

Illinois record-title limitations don’t necessarily bar an easement when physical conditions reveal its existence or use can be established through other evidence. The condition of a driveway, path, utility route, or other occupied area may therefore matter even when the recorded title doesn’t provide a complete answer.

Release & Abandonment

An easement can end when the dominant owner, meaning the property owner who benefits from the easement, releases that right. A release and a claim of abandonment are different issues. Under Illinois law, nonuse alone generally doesn’t prove abandonment; the evidence must also show an intent to relinquish the easement.

How We Evaluate Access & Land-Use Claims

We begin by identifying the source of the asserted right and the conduct that created the dispute. Our attorneys review deeds, contracts, easement language, property surveys, and historical records, along with contingencies or unusual provisions affecting the property.

Title-company records may show what was identified during a prior transaction and which rights were believed to run with the land. When appropriate, we coordinate with the title company to clarify the recorded interests and other information connected to the property.

Our evaluation may address:

  • The language and legal description in the easement agreement
  • The location and dimensions shown on a property survey
  • The duration and character of past property use
  • Evidence that access was permitted, opposed, interrupted, or released
  • Restrictions created by prior deeds or subdivision covenants

The available options depend on the easement language, property records, physical evidence, and facts of the disagreement. We can represent clients in direct negotiations or mediation when an agreed resolution remains possible. If the dispute can’t be resolved informally, we can advocate for the client during hearings or proceedings in a forum such as the Winnebago County Circuit Court.
